Going to court is one of the most stressful experiences a person can face. 

But here’s the part that catches most people off guard: 

The legal issue isn’t the only problem. The financial pressure can be just as overwhelming—and often more damaging long-term. 

After more than 10 years helping clients fund legal matters, I’ve seen the same pattern again and again: 

  • People underestimate costs  
  • They rely on the wrong advice  
  • They run out of money halfway through  
  • And that’s when bad decisions start  

This article breaks down what legal fees actually look like – and why you need to plan for them properly from day one. 

 

The True Cost of Legal Matters in Australia 

Legal costs vary – but the direction is always the same: 

  • The longer it runs, the more it costs 
  • The more emotional it is, the worse it gets 

 

  1. Family Law (The Most Common – and Most Financially Dangerous)

Typical costs: 

  • Simple divorce: $1,500 – $5,000 (so rare it belongs in a museum) 
  • Property settlement (negotiated): $10k – $40k (uncommon enough where two people can rationally settle their differences) 
  • Contested matters: $50k – $150k+ (this is the most common scenario, where there is disagreement between the partners and lawyers are needed) 
  • High-conflict litigation: $200k – $500k+ per party (sometimes there are legal fights that are one-stop short of reality TV)

Why it blows out: 

  • Two people fighting over one pool of assets  
  • Emotion driving decisions instead of strategy  
  • Endless back-and-forth between lawyers  
  • Court delays increasing billable hours  

This is the number one reason people seek legal fee funding. 

 

  1. Estate Disputes (Wills & Family Provision Claims)

These are the favourite preserve of local newspapers and gossip mongers. When money comes between family, wounds are opened that rarely heal. That’s not to say that there aren’t some people who need to be brought to account. There is nothing more infuriating than a relative with an unfounded sense of entitlement.
Be sure to budget well for this battle, warfare can be an expensive business.

  • Disputes over fairness (not just legality)  
  • Complex asset structures  

 

  1. Commercial Litigation

These can be very sensitive matters and can take a long time to bring to court.  

Typical costs: 

  • Small disputes: $20k – $100k  
  • Mid-tier: $100k – $500k  
  • Large cases: $1M+  

Why: 

  • Heavy documentation  
  • Expert witnesses  
  • Barristers and extended hearings  

 

  1. Property & Construction Disputes

‘Personally, I blame renno/property flipping TV showsIndeed, there are some excellent builders and developers around. People who have been in the industry for years and have lasted the test of time. But you won’t see them on TV because they are working hard at their business of building. These fair dinkum builders are the opposite of reality TV viewers. Ie. someone who gets into property development, because “Well I grew up in a house, yeah, no, yeah. I, like totally love looking at houses online. Also, yah know,  I’ve watched all the episodes of The Block… I mean it can’t be that hard, right?”. These are famous last words after an unusable, half-finished, building site runs out of finance and is already up to $2.3m in debt when the final sale price will only be $1.7m!!!

  • $30k – $200k+  

Why: 

  • Engineers, valuers, and reports  
  • Long timelines  
  • Technical complexity  

 

  1. Serious Criminal Defence

The less said about this the better. 

Typical costs: 

  • Basic defence: $10k – $30k  
  • Serious matters: $50k – $200k+  

 

The Pattern Behind Expensive Cases 

The most expensive legal matters always share three traits: 

  1. Uncertain outcome  
  1. High emotional or financial stakes  
  1. No ability to walk away  

 That’s why family law dominates: 

  • You can’t abandon it  
  • But you often can’t afford it either  

 

Family Court: It’s Not One Event—It’s a Process 

Most people think court is a single moment. 

It’s not. 

It’s a series of stages, with each one costing money. 

Typical Stages: 

  1. Separation  
  1. Financial disclosure  
  1. Negotiation / mediation  
  1. Interim hearings

  1. Judgment (and sometimes appeals)  
  • Every stage adds cost

People plan for the legal outcome – but not the financial journey

  • It will settle quickly  
  • Costs will stay manageable  
  • They’ll “figure it out later”

Before you even get deep into a legal matter, you should be asking: 

  • How will I fund this if it runs longer than expected?  
  • What happens if costs double?  
  • Do I have access to liquidity if needed?  

Because once you’re halfway through and under pressure: 

  • Your options shrink 
  • Your leverage drops 
  • And your decisions get worse
